Branding Court Case Over Ice-Cream Trademark Has Been Resolved

A dispute over an ice-cream trademark involving Perfect Food Solutions and the Kerry Group has been resolved at the Commercial Court, it has been reported.

According to the Irish Examiner, Perfect Food Solutions has given undertakings to cease using the name Angelita for a soft ice-cream product.

The dispute came from Kerry Luxembourg, part of the Kerry Group, who claimed that its trademark on the Angelito brand had been infringed.

It was said that Perfect Foods had engaged in ‘passing off acts’ by launching a soft ice-cream under the name Angelita in a similar fashion to Angelito.

A fast-track application had been adjourned to allow both parties to talk before the trial.

It ended up being struck out in court, as representatives for the groups informed the judge that they were happy that the matter was resolved.

Perfect Foods offered signed undertakings, including a cease and desist using the Angelita mark.
